RUI DIVING CENTRE Course Policy
Welcome to register for courses offered by RUI DIVING CENTRE. In order to ensure proper teaching arrangements, instructor scheduling, and the protection of students’ rights and interests, please carefully read and agree to the following Course Policy before registering for and attending any course. By completing registration, making payment, or participating in any course, the student shall be deemed to have read, understood, and agreed to all terms of this Policy.
1. Registration and Confirmation of Course Spots
- All course spots are subject to actual payment received and system confirmation.
- Certain courses may have limited availability due to instructor scheduling, venue capacity, equipment preparation, or third-party requirements, and spots shall be allocated on a first-come, first-served basis.
- If a student provides incomplete or inaccurate registration information, resulting in an inability to properly arrange the course, certification registration, or subsequent instruction, RUI DIVING CENTRE shall not be responsible for any resulting delays, losses, or additional expenses.
2. Payment Policy
- Students shall pay the applicable course fees in accordance with the registration page, quotation, or customer service instructions.
- RUI DIVING CENTRE reserves the right not to hold a course spot until payment has been completed.
- If a course involves material fees, certification registration fees, facility fees, boat fees, equipment rental fees, administrative fees, or other third-party charges, whether such fees are included in the total course price shall be determined by the written or electronic confirmation document provided to the student at the time of registration and capable of being saved or printed.
3. Refund Policy
- Except as otherwise required by applicable law, or where the consumer is entitled to cancellation, refund, or other remedies under applicable law, once a course has been successfully registered and paid for, no refund shall be provided under non-force majeure circumstances.
- The aforementioned “non-force majeure circumstances” include, but are not limited to:
- changes in the student’s personal schedule;
- temporary inability to attend due to personal matters;
- failure to confirm the student’s physical condition in advance;
- conflicts with work or study arrangements;
- voluntary changes to personal plans; or
- failure to arrive on time or complete the course due to personal reasons.
- If a student withdraws from a course midway for personal reasons, the fees paid shall not be refunded.
- If course fees include, or have already been used to pay for, course materials, online learning accounts, certification applications, venue reservations, boat reservations, equipment preparation, administrative processing, or similar items, such incurred fees shall not be refunded even if the student does not attend or complete the course.
4. Rescheduling Policy
- RUI DIVING CENTRE understands that students may need to adjust their course dates due to personal scheduling needs and therefore may offer flexible rescheduling within a reasonable scope.
- If a student wishes to reschedule, the student shall notify RUI DIVING CENTRE in writing as early as possible. The Centre will arrange a new course date based on instructor availability, venue availability, course progress, equipment, and available spots.
- Rescheduling does not constitute a refund. The course fees shall be retained as a tuition balance for the relevant course and applied toward the rescheduled course arrangement.
- Whether a rescheduling request is approved shall be subject to the final written confirmation of RUI DIVING CENTRE.
- In the event of multiple rescheduling requests, rescheduling requests made close to the course start time, or where third-party costs have already been incurred, RUI DIVING CENTRE reserves the right to charge a reasonable rescheduling fee, rebooking fee, or require payment of any price difference.
- If course prices, facility fees, boat fees, certification fees, or other costs change after rescheduling, the student may be required to pay the difference.
- If a student fails to complete the rescheduling and re-attend the course within one year, RUI DIVING CENTRE reserves the right to deem the course voluntarily forfeited by the student, and all fees paid shall be non-refundable.
5. Late Arrival, Absence, and Deemed Forfeiture
- Students shall arrive on time at the designated location to attend theory classes, pool sessions, open water sessions, or other activities.
- If a student is late, absent, fails to complete pre-course study, fails to bring the necessary documents, or otherwise fails to meet the basic requirements for participation in the scheduled session, RUI DIVING CENTRE reserves the right to deny the student participation in that session.
- If a student is unable to participate in the course normally due to lateness, absence, or insufficient preparation, no refund shall be issued. However, the student may apply for rescheduling depending on the circumstances. For rescheduling requests made within 12 hours prior to the course start time, a rescheduling fee of CAD 149.00 shall be charged.
6. Health and Safety
- Diving activities involve inherent risks. Students shall truthfully disclose their health condition, diving experience, and other relevant information.
- If a student has any physical, psychological, or safety-related condition that makes the student unsuitable for diving or course participation, RUI DIVING CENTRE, its instructors, or relevant staff reserve the right to require a doctor’s note, suspend the course, reschedule the course, or terminate the student’s continued participation.
- If a student conceals, misrepresents, or omits health information, resulting in losses, risks, additional expenses, or an inability to complete the course, RUI DIVING CENTRE shall not be liable, and the related fees shall not be refunded.
- Students must comply with all safety requirements and operating instructions issued by instructors, dive leaders, and staff. For any student who refuses to follow safety instructions or endangers themselves or others, RUI DIVING CENTRE reserves the right to terminate that student’s course participation without refund.
7. Weather, Sea Conditions, Venue, and Operational Adjustments
- Diving courses may be affected by weather, water conditions, visibility, temperature, venue limitations, boat schedules, instructor scheduling, equipment conditions, safety assessments, or third-party operational factors.
- In order to ensure safety and teaching quality, RUI DIVING CENTRE reserves the right to adjust course times, locations, instructors, training sequence, or teaching arrangements.
- If postponement is required for safety reasons or operational reasons, RUI DIVING CENTRE will use reasonable efforts to arrange a make-up session or rescheduling for the student. Such circumstances generally shall not constitute grounds for a refund, unless otherwise required by law or otherwise agreed by RUI DIVING CENTRE.
8. Force Majeure
- If a course cannot proceed as originally planned due to force majeure, neither party shall be deemed to be in breach.
- “Force majeure” includes, but is not limited to, natural disasters, extreme weather, government orders, public health events, war, riots, strikes, transportation interruptions, venue closures, third-party service interruptions, or any other events beyond reasonable control.
- In the event of force majeure, RUI DIVING CENTRE may, depending on the actual circumstances, arrange postponement, rescheduling, course credit, or other reasonable solutions.
- Nothing in this section shall limit any statutory rights to cancellation, refund, or other remedies to which a consumer may be entitled under applicable law.
9. Course Completion and Certification
- Students must complete the required theory study, knowledge reviews, skill practice, performance requirements, and all other certification conditions in accordance with the standards of the relevant course before becoming eligible for course completion or certification.
- Registration for and payment of a course do not automatically guarantee certification.
- If a student fails to pass the course due to insufficient skills, inadequate learning progress, poor safety awareness, non-compliance with instructional requirements, or any other reason, RUI DIVING CENTRE may require the student to attend additional training, repeat sessions, or undertake further instruction, and any related additional costs shall be borne by the student.
10. Equipment and Personal Belongings
- Students shall prepare personal equipment, documents, and items suitable for diving activities as required by the course.
- If the course includes equipment rental, students shall use the equipment properly and return it as required. Any damage, loss, or extra cleaning and maintenance caused by human error shall be borne by the student.
- Students are responsible for safeguarding their own personal belongings. Unless otherwise required by law, RUI DIVING CENTRE shall not be liable for lost, damaged, or stolen personal items.

11. Use of Photos, Videos, and Promotional Materials
- Subject to applicable law, RUI DIVING CENTRE may take photographs or videos during courses, training sessions, or activities for teaching records, quality management, social media display, or marketing purposes.
- If a student does not consent to the use of their likeness for promotional purposes, the student shall notify RUI DIVING CENTRE in writing before participating in the course.
- If separate authorization or consent is required by law, the applicable law shall prevail.
12. Limitation of Liability
- To the fullest extent permitted by applicable law, RUI DIVING CENTRE shall not be liable for any indirect, incidental, consequential, profit-related, opportunity-related, or third-party-caused losses.
- If RUI DIVING CENTRE is found liable, its liability shall, to the extent permitted by law, be limited to the amount of fees actually paid by the student for the relevant course.
- Nothing in these terms excludes any consumer rights that cannot be excluded under applicable law.
13. Policy Updates and Governing Law
- RUI DIVING CENTRE reserves the right to update this Course Policy from time to time based on operational needs, legal requirements, course arrangements, or safety management needs.
- The latest version shall be the version published on the official website, registration page, in-store notice, or written notice.
- This Policy shall be governed by applicable law. In the event of any conflict between this Policy and applicable law, the applicable law shall prevail.
